How to Handle a Local Law 5 Violation (LL5, LL5/73)

LL5 and LL5/73 are the violation-number codes for Local Law 5 of 1973. The types page gives both the same subject: fire safety in office buildings. It does not define the two codes separately. The Department’s fire-safety resolving page limits these violations to high-rise office buildings. The notice states the condition. Local Law 16 of 1984, code LL16/84, is a different fire-safety label.

Read the notice

Confirm the number contains LL5 or LL5/73. An asterisk means the types page marks the item dismissed. Do not read a boiler code, a facade code, or LL16/84 as this law because the paper mentions fire safety in some other way.

The resolving page says these violations were issued by the Fire Department and may need administrative dismissal by the Department of Buildings. That is a different history from an ordinary OATH construction summons. Older Buildings papers still say ECB. Current Buildings pages call that hearing path an OATH summons. OATH is not part of the Department of Buildings and does not issue the summons. The fire-safety resolving page lists Local Law 5 as a DOB violation to resolve, separate from OATH construction summonses. Read your own paper for a hearing date. Do not assume one.

If a class is printed, Class 1 is immediately hazardous, Class 2 is major, and Class 3 is lesser. The class is severity, not a second Local Law 5 type. The codes do not set it. A DOB violation includes an order to correct and has no court appearance. Serious conditions on a DOB violation may result in a Criminal Court summons. That is a separate track. It is not printed into the LL5 label.

What the city is requiring

Follow the condition on the notice. The resolving page says the requirements vary by the height of the building and by whether the building has central or non-central air conditioning. It does not print a single scope of work, a form number, or a penalty amount for every LL5 file. Do not invent one from the code alone.

What the owner has to show is whatever that notice says is still open, together with proof the issuing office will accept. If the page’s administrative-dismissal path applies, that is a Department step, not a repair method. The Facade and Local Law Unit also enforces Local Law 26 of 2004. That is not LL5, and the unit page does not list Local Law 26 subtypes.

What S & M Expediting handles

S & M Expediting researches the LL5 or LL5/73 paper and whether it is being handled as a DOB violation, including a possible administrative dismissal, or as a summons. They prepare and file the certificate of correction and the related Department filings, and they follow them. When the paper is a summons, they can appear at the OATH hearing.

They are Class 2 filing representatives, never Class 1. We will work with the contractor you have for the fire-safety work on the notice, or if not, we will recommend one from our network. violation removal is the research and the filings.

Who does the corrective work

Hire the licensed professional the notice requires for the fire-safety condition it names. Because the requirements vary by height and by the air-conditioning system, the paper controls the trade. We will work with the contractor you have for the fire-safety work on the notice, or if not, we will recommend one from our network.
