How to Handle a Local Law 58 Violation (LL58, LL58/88)
LL58 and LL58/88 are the violation-number codes for Local Law 58 of 1988. The types page labels both as penalties for work without a permit. It does not define the two codes separately. The notice states the work and the condition. VW is work without a permit. VWH is hazardous work without a permit. VPW is pending work without a permit. Those are different codes, not suffixes of LL58.
Read the notice
Confirm the number contains LL58 or LL58/88. An asterisk means the types page marks the item dismissed. Elevator work without a permit uses VEW, VECW, VEWL, or VWL. Do not file this law’s paper under an elevator-lien code, or the reverse, unless the number actually says so.
Older summonses say ECB. Current pages call that hearing path an OATH summons. OATH holds the hearing. OATH is not part of the Department of Buildings and does not issue the summons. A DOB violation orders correction and has no court appearance. Work without a permit is often a summons, but the paper in your hand controls.
The classification table lists work without a permit as Class 1, Class 2, and Class 3. The class on your paper is the severity of that charge. It is not chosen by the letters LL58. If a class is printed, Class 1 is immediately hazardous, Class 2 is major, and Class 3 is lesser. On a summons, read the hearing date and any cure date. A cure is an admission. Unless OATH dismisses the summons, the condition must still be corrected and accepted. Paying the penalty does not close the Department record.
What the city is requiring
Follow the unpermitted work described on the notice. If a summons was issued for work without a permit, Department civil penalties must be paid or waived before a certificate of correction is approved. That happens in the borough office that issued the summons. The page does not print the dollar amount.
A stop-work order issued for work without a permit is not lifted just because a permit is later issued. Work that starts again before the order is rescinded can draw more violations. The Department will not rescind the order until those penalties are paid. A full stop-work order stops all work except remedial work to make the site safe. A partial order stops only what it names.
The table also names related charges that are not the LL58 label itself: construction or alteration without a permit in a manufacturing district for residential use, plumbing work without a permit in that setting, demolition without a demolition permit, electrical work without a permit, and an outdoor sign on a display structure without a permit. Use the charge the notice prints.
