FDNY Certificate of Correction and Violation Filings

A Fire Department summons is not a fire-alarm design. S & M Expediting follows Fire Department violations and prepares the filings to answer them. We do not design fire alarms, and we do not install them.

What the summons is

An FDNY violation is an official notice that a property does not comply with the New York City Fire Code or Fire Department rules. Violations can come from an FDNY inspection or from a complaint to the City.

The Fire Department issues several kinds of notices: an FDNY summons, a Criminal Court summons, a Violation Order, and a Vacate Order. This page is mainly about the FDNY summons.

Fire Department summons cases are often heard at OATH, the same way a Buildings Department summons is. Start with what an ECB violation is and how to check your property, then how to resolve an ECB violation. Paying the fine does not close the record by itself.

How an FDNY certificate of correction works

When you receive an FDNY summons, the unsafe condition has to be corrected, and proof of the correction goes to the Fire Department. That proof is the certificate of correction.

  • The deadline is on the summons. File the certificate of correction by the compliance date printed on the summons. FDNY’s violations page says the Fire Department must receive it within 35 days of the date the violation was issued to avoid a penalty and a hearing. After that, you must appear at OATH and bring your proof of correction.
  • The form is notarized. You complete the Certificate of Correction, have your signature notarized, and attach a copy of the summons plus bills, receipts, or other proof that the work was done.
  • It is filed online. Certificate of Correction requests are filed through FDNY Business. FDNY no longer accepts them by email.
  • FDNY reviews it and answers. A first offender whose correction is accepted gets a Cure Letter and does not have to attend the OATH hearing. A repeat offender, as noted on the summons, must still attend the hearing. If FDNY disapproves the request, for example because a violation category is still open, it has to be corrected and resubmitted. If FDNY finds the certificate falsely certified, you must attend the hearing.

A Violation Order or a Vacate Order is handled differently: proof of correction goes to the FDNY unit named on the order.

What we file

We look up the summons and prepare the correction filing: the certificate of correction, the supporting proof you give us, and the online request. The lookup steps are on our OATH summons page. Homeowners who find one of these during a sale can start on the homeowners page.

A sprinkler permit filed with the Buildings Department is a different filing.

OATH hearings on FDNY summonses

We also attend OATH hearings on FDNY summonses. A hearing is still needed when the certificate of correction was not filed in time, when FDNY disapproves it or finds it falsely certified, or when the summons says the respondent is a repeat offender. In those cases we appear at the OATH hearing on the FDNY case and present the proof of correction.

Who does the corrective work

The condition on the summons has to be fixed by the right licensed trade before anything is certified. We will work with the contractor you have, or if not, we will recommend one from our network.
