How to Handle an Unsafe Building Violation (UB)

UB is the unsafe building code in a Department of Buildings violation number. The types page gives UB that meaning. UB% and V% are precepts issued for an unsafe-buildings violation. They are not extra types, and they are not separate violation categories. V alone is the general DOB violation code. A percent mark does not turn it into UB. The notice states the condition.

Read the notice

Confirm whether the number is UB, or a precept marked UB% or V%. An asterisk means the types page marks the item dismissed. A vacate order is VAC. An order of closure, the padlock order, is VCLOS. A facade unsafe condition under Local Law 11 is a different code. Do not merge those papers because each uses the word unsafe.

Older summonses say ECB. Current pages call that hearing path an OATH summons. OATH holds the hearing. OATH is not part of the Department of Buildings and does not issue the summons. A DOB violation orders correction and has no court appearance. Serious conditions may result in a Criminal Court summons. That is a separate track from the UB label. Read what your paper requires.

If a class is printed, Class 1 is immediately hazardous, Class 2 is major, and Class 3 is lesser. The class is severity. UB does not set it. The Structurally Compromised Buildings unit’s table lines, below, carry their own classes when the notice is that charge. On a summons, use the hearing date and any cure date on that summons. Paying the penalty does not close the Department record.

What the city is requiring

Follow the condition on the notice. The Structurally Compromised Buildings unit enforces Administrative Code section 28-217. A potentially structurally compromised building is one of four things the page describes. It has an open roof for 60 days or longer. It is shored or braced under an emergency declaration. It is subject to a precept as a compromised structure. Or the Commissioner finds it may have structural damage. The 60 days is part of that description of an open roof. It is not a cure deadline printed on the UB label.

The classification table lists two related charges. Failure to immediately notify the Department that a building has become potentially compromised is Class 1. Failure to submit a required inspection report of a potentially compromised building is Class 2. Those duties apply when the notice is that charge. The types page does not add a form number or a dollar amount to UB, UB%, or V%.
