How to Handle Hazardous Work Without a Permit (VWH)
VWH is the violation-number code for work without a permit, hazardous. The types page gives those letters that label. It does not publish a separate penalty, form, or deadline for VWH beyond that label. The notice states the work and the condition. VW is work without a permit without the hazardous label. VH is a hazardous violation and is not, by itself, work without a permit. VPW means pending, work without a permit.
Read the notice
Confirm the number contains VWH. An asterisk means the types page marks the item dismissed. Elevator work without a permit, including the lien codes VEWL and VWL, is a different set of letters. Local Law 58 of 1988 is another label for penalties for work without a permit. Keep the paper that matches the number.
Older summonses say ECB. Current pages call that hearing path an OATH summons. OATH holds the hearing. OATH is not part of the Department of Buildings and does not issue the summons. A DOB violation orders correction and has no court appearance. Class 1 means immediately hazardous, Class 2 means major, and Class 3 means lesser. That class is severity. It is not the same thing as the word hazardous in VWH, and the code does not set the class.
On a summons, read the hearing date and any cure date. A cure, where the schedule allows it, requires an acceptable certificate of correction by that date and is an admission. Unless OATH dismisses the summons, the condition must still be corrected and accepted. Paying the penalty does not close the Department record.
What the city is requiring
Follow the hazardous unpermitted work described on the notice. Where the paper is a summons for work without a permit, Department civil penalties must be paid or waived before a certificate of correction is approved, in the borough office that issued it. The page does not print the dollar amount, and it does not print a different amount for the hazardous label.
A stop-work order issued for work without a permit is not lifted just because a permit is later issued. Work that resumes before the order is rescinded can draw more violations. The Department will not rescind the order until those penalties are paid. A full order stops all work except remedial work to make the site safe. A partial order stops only what it names.
The types page does not list the trades VWH covers. The classification table’s specific unpermitted-work lines, such as demolition without a demolition permit or electrical work without a permit, apply only when the notice states that charge. Do not pick one because the code says hazardous.
