HPD Violation Removal and Dismissal Requests in NYC

The Department of Housing Preservation and Development (HPD) issues violations under the NYC Housing Maintenance Code and the New York State Multiple Dwelling Law. They stay on the building’s record until HPD clears them, and buyers, lenders and tenants can all see them on HPDONLINE. Start with HPDONLINE

Enter the property address on HPDONLINE to see open violations and orders. Each violation has a class:

  • Class A: non-hazardous
  • Class B: hazardous
  • Class C: immediately hazardous
  • Class I: HPD Orders to Repair and Orders to Repair/Vacate

The violation’s status tells you which route applies. A violation that is still within its certification period is handled differently from one that is overdue, falsely certified, or in “Defect” status.

Newly issued violations: certification of correction

New violations arrive as a Notice of Violation (NOV), mailed to the registered managing agent or owner. The NOV shows the date the condition must be corrected and the date the owner must certify the correction to HPD. Certification of correction is free. It can be filed on paper or through eCertification. Lead-based paint, mold and pest violations can’t be certified through eCertification.

HPD lists how long an owner has to correct, counted from the date of service, before civil penalties apply if they are sought in Housing Court:

Class Time to correct
A, non-hazardous 90 days
B, hazardous 30 days
C, lead-based paint, window guards, mold, mice/cockroaches, rats 21 days
C, self-closing doors 14 days
C, heat and hot water No time
All other Class C 24 hours

Certify only after the work is actually done. HPD may audit any certification, and tenants are notified and can challenge it. A violation found uncorrected after certification goes into False Certification status, stays open, and can bring civil penalties and placement on HPD’s Certification Watchlist.

Overdue or falsely certified violations: dismissal request

If a violation wasn’t certified on time, or was found falsely certified, HPD may require a Dismissal Request reinspection before it can be removed. The owner submits an application, there is a fee, and one request can cover all or some of the violations at the property. Read the application in full first: new violations may be issued during the inspection.

Effective July 1, 2026, HPD says dismissal request applications should go directly to Code Enforcement – Central Violations Administration Unit, 345 Adams Street, 10th Floor, Brooklyn, NY.

Other routes HPD lists

  • Documentation plus inspection (“Defect” status): mostly lead-based paint, mold and pest violations. These need the documents HPD lists on its Lead-Based Paint or Allergen Hazards pages.
  • Violation Reissuance: a certification program for old violations at certain buildings. It lets the owner certify reissued violations by new dates. Not every violation or building qualifies.

  • prepare the Dismissal Request application for violations that are overdue or were falsely certified, and send it to the HPD unit named on the application
  • check DOB and ECB records at the same time, since a sale or refinance usually needs all of them cleared
